PROTECTING EUROPEAN UNION VALUES: Breaches of Article 2 TUE and their Consequences

We are pleased to invite you to participate in the conference „PROTECTING EUROPEAN UNION VALUES: Breaches of Article 2 TUE and their Consequences” to be hosted by the University of Warsaw, Faculty of Law and Administration, Chair of European Law and the Max Planck Institute for Comparative Public Law and International Law in Heidelberg.

The conference will be held in Warsaw, on 14-15 September 2017.

In January 2016, the European Commission activated its new mechanism to combat systemic deficiencies in the rule of law in certain Member States of the EU, the „EU Framework to strengthen the Rule of Law”, for the first time. Its addressee is Poland, where the government undertook substantial changes regarding the Constitutional Tribunal, the media and several other areas of law which are of key importance to the rule of law. Since then, an uneasy dialogue on the situation in Poland has been under way between the European Commission and the Polish government. As of today, the Rule of Law Framework has reached its final stage concerning Poland without considerable results.
In July 2017, the European Commssion sent to Poland new recommendation covering, among other things, the new law on the ordinary courts which, in the view of the European Commission, will structurally undermine the independence of the judiciary in Poland and have an immediate and very significant negative impact on the independent functioning of the judiciary. Apart from the recommendation, the European Commission sent to Poland the Letter of Formal Notice and, consequently, started infringement proceedings against Poland under Article 258 of the Treaty on the functioning of the European Union.

Although the whole topic is politically very sensitive, we are of the opinion that a legal and academic analysis is due. For this reason, we have invited a panel of academics of the highest quality, judges and representatives of the European Commission and the Council of Europe.
